The decedent husband, who divorced and then years later remarried neglected to change the beneficiary on his life insurance policy previously included in his retirement package from a large national company. The former spouse, contrary to what the Divorce Judgment provided, refused to turn over the funds that she wrongfully claimed and deposited.
The insurance company had not been made aware of the filing of any divorce and the widow did not learn about it until after the payment was already wrongfully made.
After opening her husband’s Probate estate and starting a lawsuit against the former wife, the case was immediately settled as the former wife’s attorneys immediately recognized that Lipson Neilson was going to aggressively prosecute the ex-wife under claims that included fraud, misrepresentation, conversion and violation of the parties Court Ordered Divorce Degree.
