David Clark successfully defended an insurance client which denied coverage under an appraiser professional liability policy. Plaintiff had taken assignment of the insured’s claims and filed suit in federal court, seeking compensatory damages in the high seven figures and punitive damages for bad faith.
Led by Mr. Clark, the firm prevailed on a motion to dismiss the bad faith claims at the outset of litigation. Following discovery, Mr. Clark prevailed on summary judgment on the remaining breach of contract claim, for a complete defense judgment.
